ZBA Hearing Minutes

Hearing began at: 3pm

Members Present:  Jonathan Levin, Chair, Stanley Ross, Clerk, Robert Lazzarini, Fred Chapman and Susan Cooper

Also present: Pamela Sandler

The hearing began with Jonathan Levin, Chair, explaining the hearing process and then Stanley Ross, Clerk, read the legal notice (which was posted for 2 consecutive weeks in the Berkshire Eagle and at the Town Hall) and letters from the Planning Board, Conservation Commission, and Board of Health.

Pamela Sandler was present to review the proposed project with the Board.  There will not be any alterations to the front of the house.  The existing porch is screened in and will remain that way in the new proposal.  The area under the porch will be covered with lattice and will have doors to access the items being stored underneath.

At this point the Board closed the public portion of the hearing and went into their deliberations.

The Board made the following findings:
1.  The lot and structure are non-conforming lot because there is insufficient road frontage and there is a virtual 100% infringement of the front setback requirement.
2.  No abutter objections were received.
3.  Proposed changes are relatively minor and do not to appear to be something that will change the perspective from the lake and as a result are not substantially more detrimental to the neighborhood.

A motion was made to accept the project as proposed.  The motion was seconded and passed unanimously.
